365news gathered that Asiwaju Bola Tinubu, the All Progressives Congress (APC2023 )’s presidential candidate, has renounced one of the lawsuits the party brought to have him declared ineligible, according to NAN.
This was disclosed in a statement released on Friday in Abuja by Mr. Bayo Onanuga, Director of Media and Publicity for the APC Presidential Campaign Council (PCC).
According to Onanuga, they informed Justice Binta Nyako of the Federal High Court’s Abuja Judicial Division that the lawsuit was illegal and that the party had expelled the masterminds’ top executives.
He claimed that on November 22, Justice Nyako had authorized the validly elected chairman and secretary’s request to be included in the lawsuit.
He recalled that Action Alliance had brought the lawsuit against INEC, the APC, Sen. Bola Tinubu, and Sen. Kashim Shettima as the first, second, third, and fourth defendants, respectively.
The suit was never authorized by the proper party organs, the APC PCC Director of Media and Publicity said, and the court upheld this claim by granting permission.
In his judgement, Justice Nyako stated that the primary factor in a joinder application was whether the applicant seeking to be joined was a necessary party, meaning that the outcome would have some bearing on them.
“The plaintiffs and respondents have not placed anything that would convince the court not to allow them into the case.
“I am of the opinion that they are necessary to the case to determine if the case was properly instituted or not.
“Consequently, the application succeeds and the applicants are hereby joined as parties to this action as Defendants,” Onanuga quoted the Judge as saying.
According to him, Justice Ishola of Babatunde Ogala chambers stands for the APC, Thomas Ojo for Tinubu, while Mr C.I. Ibenegbu stands for Shettima, Tinubu’s Vice-Presidential running mate.
